Terms of Use

These Terms of Use ("Terms") govern your access to and use of the StorScale platform, website, APIs, and related services (collectively, the "Services") provided by StorScale LLC ("StorScale", "we", "us", or "our"). By creating an account, clicking "I agree", or using the Services, you agree to be bound by these Terms. If you're agreeing on behalf of a company, you represent that you're authorized to bind that company.
The short version: StorScale gives you market intelligence and pricing recommendations for self-storage. The recommendations are informational — you decide what to do. We're not a financial or legal advisor. Liability is capped at fees paid in the 12 months before a claim. Texas law governs. Do not use the Services to break the law or harm other users.
1. Services
StorScale provides revenue intelligence, competitive rate monitoring, marketing analytics, SEO tooling, and automated pricing recommendations for self-storage operators. Services include the Free Facility Audit, paid subscription tiers (Monitor, Optimize, Command), web interfaces, APIs, reports, and related content. Features available to you depend on the subscription tier you purchase.
2. Account registration
- You must provide accurate, current, and complete information when creating an account.
- You are responsible for all activity under your account and for maintaining the security of your credentials.
- You must notify hello@storscale.ai immediately of any unauthorized access.
- You must be at least 18 years old.
- You may not share your account, resell access, or allow multiple users to access a single seat. Team plans are billed per user.
3. Acceptable use
Your use of the Services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violating the AUP is a material breach of these Terms and grounds for suspension or termination.
4. Subscriptions and billing
- Paid plans are billed in advance — monthly or annually, as selected at purchase.
- All fees are in US dollars and are non-refundable except as required by law or as expressly stated in your order form.
- We may adjust pricing with at least 30 days' written notice; existing subscriptions remain at their current rate until the next renewal.
- Founding Member and promotional pricing is locked as long as the account remains active and in good standing. Lapse, downgrade, or cancellation forfeits the promotional rate.
- You may cancel any time from your account settings. Access continues through the end of the current paid period; we do not prorate refunds.
- If payment fails, we will retry and notify you. Persistent failure after 14 days will result in suspension.
- Taxes — where legally required, we add and remit sales, use, VAT, or equivalent taxes. You are responsible for any taxes attributable to use outside the U.S.
5. Free Facility Audit and free tools
- Our free audit tools provide estimated revenue gaps, rate benchmarks, and operational scores based on publicly available data.
- Results are indicative, not financial advice. Actual revenue depends on execution, market conditions, and factors outside StorScale's control.
- By submitting an audit request, you authorize us to analyze publicly available data about the facility at the address you provided and to contact you about the results.
- We may use aggregated, de-identified audit data for benchmarking and research.
6. Automated recommendations and AI-generated output
StorScale uses automated systems — including third-party artificial intelligence models — to generate pricing recommendations, competitor summaries, marketing copy, SEO recommendations, ad creative, and other output ("Automated Output"). You should understand:
- Informational only. Automated Output is informational and is not financial, legal, investment, tax, or professional advice.
- No warranty of accuracy. Automated Output may be inaccurate, outdated, biased, or incomplete. Market data changes rapidly. Models can and do make mistakes.
- You are the decision-maker. You retain sole authority and responsibility for every pricing change, marketing action, or business decision you make. StorScale does not act on your behalf and is not a fiduciary.
- Review before acting. You are responsible for reviewing Automated Output for accuracy and suitability before relying on it. Recommendations accepted or applied through the Services (e.g., rate updates written back to your PMS) are applied at your direction and under your authority.
- Subprocessors. AI subprocessors are listed in our Privacy Policy. We do not use customer personal information to train third-party AI models.
To the maximum extent permitted by law, StorScale is not responsible for lost revenue, lost occupancy, regulatory fines, reputational harm, or other damages resulting from your use of Automated Output.
7. Property Management System (PMS) integration
- Scope. Where you connect a PMS (Storable/SiteLink, Tenant Inc, Yardi Breeze, storEDGE, Easy Storage Solutions, or others), StorScale accesses rate, unit, occupancy, and operational data in read-only mode unless you explicitly authorize write-back.
- Write-back authorization. Rate updates ("ECRI", promotional pricing, rate parity changes) are only written back to your PMS on Command tier with explicit, facility-level opt-in from an authorized user. You can suspend or reverse write-back at any time from your account settings.
- Authority representation. You warrant that you have authority to connect the relevant PMS instance(s), that such connection is permitted under your PMS agreement, and that you will hold StorScale harmless from any third-party claim arising from lack of such authority.
- No write to lease or PII. StorScale does not write to tenant personal information, payment records, lease terms, or legal documents.
- Suspension. If a PMS provider updates its terms to prohibit integration or revokes our access, we may suspend the integration for affected customers without liability.
8. Competitor monitoring
- StorScale collects competitor pricing data from public sources — competitor websites, public listings, Google Maps, and licensed market data providers such as StorTrack.
- We do not scrape paywalled or login-gated content, nor circumvent technical measures against access.
- Competitor data is provided for your internal business use only. You may not redistribute, resell, or publish competitor data extracted from the Services.
- If you upload data obtained from third parties, you represent that you have the rights to do so and you indemnify StorScale against any third-party claim related to that upload.
9. Third-party integrations and data providers
The Services integrate with third-party services including Google Analytics, Google Ads, Google Business Profile, Google Search Console, Google Tag Manager, Microsoft Clarity, BrightLocal, DataForSEO, StorTrack, Meta Ads, and others. Your use of those third-party services is governed by their own terms. StorScale is not responsible for third-party outages, policy changes, rate limits, or data quality. If a third-party service revokes our access, we will notify affected customers and work to restore equivalent functionality where possible.
10. Beta, preview, and early-access features
Features marked "Beta", "Preview", "Early Access", or equivalent are provided as-is, without warranty, and may change or be withdrawn. StorScale does not commit to any SLA or uptime for beta features. Feedback you provide on beta features may be incorporated into the Services without compensation.
11. Data, content, and intellectual property
11.1 Your content
You retain ownership of data and content you upload or input ("Customer Content"). You grant StorScale a limited, worldwide, non-exclusive, royalty-free license to process Customer Content solely to provide, secure, and improve the Services for you, subject to our Privacy Policy and DPA.
11.2 Our content
Market data, analytics, scores, benchmarks, recommendations, and other output produced by the Services ("StorScale Content") is StorScale's intellectual property or licensed from third-party providers. You receive a limited, non-exclusive, non-transferable license to use StorScale Content for your internal business purposes during your subscription. You may not redistribute, resell, or use StorScale Content to train machine learning models or competing products.
11.3 Our platform
The StorScale platform — including code, designs, algorithms, models, documentation, and trademarks — is our exclusive intellectual property, protected by copyright, trademark, and other laws.
12. Data processing and security
Our collection and use of personal information is described in the Privacy Policy. Enterprise customers may request our Data Processing Agreement. We maintain commercially reasonable security measures including TLS in transit, encryption at rest, row-level security, access controls, MFA on privileged accounts, logging, and incident response procedures.
13. Disclaimers
THE SERVICES AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. STORSCALE DOES NOT WARRANT THAT:
- The Services will be uninterrupted, error-free, or secure;
- Market data, competitor rates, scores, or pricing recommendations will be accurate, complete, or timely;
- Revenue or occupancy projections will reflect actual results;
- Third-party integrations will remain available or unchanged;
- Automated Output will be free from error or bias.
StorScale is a market intelligence and automation tool, not a financial, legal, or investment advisor. Pricing, marketing, and operational decisions remain solely your responsibility.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STORSCALE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OCCUPANCY, GOODWILL, OR DATA, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
STORSCALE'S TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (a) ONE HUNDRED U.S. DOLLARS (US$100), OR (b) THE TOTAL AMOUNT YOU PAID STORSCALE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to defend, indemnify, and hold harmless StorScale and its officers, directors, employees, and agents from any third-party claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Services in violation of these Terms or applicable law; (b) Customer Content you upload or inputs you provide; (c) your violation of the Acceptable Use Policy; (d) actions you take based on Automated Output; (e) your lack of authority to connect a PMS or other integration; or (f) your misuse of competitor data obtained through the Services.
16. Suspension and termination
- You may cancel at any time from your account settings.
- We may suspend or terminate your access at any time, with or without notice, if you (a) materially breach these Terms or the AUP, (b) fail to pay when due, (c) use the Services in a way that creates risk for StorScale, its users, or third parties, or (d) are required to do so by law or court order.
- On termination, your license to use the Services ends. Customer Content will be available for export for 30 days unless we are required to delete earlier by law, and will be permanently deleted within 60 days after the export window closes.
- Sections that by their nature should survive termination (including 11, 13, 14, 15, 17, 18) will survive.
17. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Exclusive venue and jurisdiction for any dispute arising under or relating to these Terms or the Services will be the state and federal courts located in Travis County, Texas, and you consent to personal jurisdiction there.
Before filing a claim, you agree to first contact us at hello@storscale.ai and attempt to resolve the dispute in good faith for 60 days. Either party may seek injunctive relief for infringement of intellectual property or breach of confidentiality at any time.
18. General
- Entire agreement. These Terms, plus the AUP, Privacy Policy, and any applicable Order Form or DPA, constitute the entire agreement between you and StorScale.
- Modifications. We may update these Terms by posting an updated version and providing notice via email or in-product notification. Material changes take effect 30 days after posting. Continued use after the effective date constitutes acceptance.
- Severability. If any provision is unenforceable, the remaining provisions remain in effect.
- Waiver. Failure to enforce any provision is not a waiver.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
- Force majeure. Neither party is liable for failure or delay due to events beyond reasonable control, including internet outages, third-party service failures, natural disasters, or government action.
- Notices. Notices to StorScale: hello@storscale.ai. Notices to you: the email address on file.
- Independent contractors. No agency, partnership, joint venture, or employment relationship is created by these Terms.
- Headings. Headings are for convenience and do not affect interpretation.
